This Preliminary Information Form has been prepared to inform consumers prior to making a purchase in connection with distance sales conducted through the HÛ NEFES website. This form provides preliminary information regarding the essential characteristics of the product or service, the sales price, payment and delivery terms, the right of withdrawal, return conditions, and the parties’ contact information, in accordance with the Consumer Protection Law No. 6502, the Regulation on Distance Contracts, and related legislation.
Before completing their order and assuming any payment obligation, consumers have the opportunity to review the order details, the Pre-Contract Information Form, and the Distance Selling Agreement.

The Buyer’s first name, last name, address, phone number, email address, billing, and shipping information consist of the details provided by the Buyer at the time of the order.
3. Key Characteristics of the Product or Service
The type, quantity, key features, and other characteristics of the product, digital content, or service covered by the order are specified on the relevant product page and on the order summary screen.
In addition to physical products, HÛ NEFES offers PDFs, e-books, audio files, downloadable content, and similar digital products. The features, price, delivery or access method, and any specific terms of use for each product or service are displayed on the relevant product page.
Before completing the purchase, the buyer can review the basic features of the product or service they have ordered.
4. Sales Price and Additional Costs
The total sales price of the product or service being ordered, including all taxes, is displayed to the Buyer before the payment transaction is completed.
Any shipping, delivery, or other additional costs to be paid by the Buyer will also be specified separately before the order is completed.
The total cost of the order is visible to the Buyer on the order summary and payment screens before the purchase is completed.
5. Payment Method
The buyer may complete the payment using the appropriate payment method offered on the HÛ NEFES website during the ordering process.
The available payment methods are displayed to the Buyer during the checkout process. If the payment transaction is not successfully completed, the order may not be considered complete.
6. Delivery of Physical Products
Physical products are shipped to the shipping address provided by the Buyer at the time of order. Any applicable shipping or handling fees are displayed to the Buyer before the order is finalized.
Delivery times may vary depending on the nature of the product, stock availability, delivery address, and shipping conditions. Unless the parties agree on a different delivery time, delivery will be made within the timeframes specified in the applicable laws and regulations.
In the event that fulfillment of the order becomes impossible, the Buyer will be notified in accordance with applicable laws, and any amounts already collected will be refunded within the timeframe specified by law.
7. Delivery and Access to Digital Products
PDFs, e-books, audio files, and other downloadable digital content may, depending on the nature of the product, be made available for download electronically, assigned to the Buyer’s account, or made accessible to the Buyer via electronic communication once the payment process is complete.
The internet connection, device, software, or other technical requirements necessary to use a digital product may vary depending on the nature of the product. Any specific technical requirements and terms of use, if applicable, are listed on the relevant product page.
8. Right of Withdrawal
In distance contracts where the right of withdrawal is not excluded, the Buyer has the right to withdraw from the contract within fourteen days, without providing any reason and without paying a penalty, in accordance with the conditions set forth in the applicable legislation.
In sales of goods, the right of withdrawal generally begins on the date the Buyer or a third party designated by the Buyer takes delivery of the goods; in service contracts, it begins on the date the contract is concluded.
The buyer may exercise the right of withdrawal even before delivery of the goods. To exercise the right of withdrawal, a notice of withdrawal must be submitted to the seller in writing or via a durable medium recognized by law within the prescribed timeframe.
9. Right of Withdrawal for Digital Products
The right of withdrawal for digital products may vary depending on the nature of the product and the method of delivery or performance.
Contracts for services performed instantly in an electronic environment and for intangible digital content delivered instantly to the consumer may fall under the exceptions to the right of withdrawal, provided that the conditions set forth in the applicable legislation are met.
For this reason, whether a right of withdrawal applies to digital content such as PDFs, e-books, downloadable audio files, and similar items is determined based on the method of delivery and performance of the product, as well as applicable laws.
In cases where there is no right of withdrawal or where it cannot be exercised unless certain conditions are met, the consumer is informed of this before completing the order.
10. Other Exceptions to the Right of Withdrawal
Subject to the exceptions to the right of withdrawal specified in the applicable legislation.
Products prepared in accordance with the consumer’s requests or personal needs, perishable products, products that cannot be returned for health or hygiene reasons because their protective packaging has been opened after delivery, and other goods or services specified in the regulations may fall under the exceptions to the right of withdrawal, provided that the necessary conditions are met.
Whether the right of withdrawal applies to a particular product or service is determined based on the nature of the product and the applicable laws.
11. Notice of Withdrawal

The buyer must clearly communicate the notice of withdrawal. The return of physical products subject to the right of withdrawal shall be carried out in accordance with the timeframes and conditions specified in the applicable legislation.
12. Returns and Refunds
Refunds required when the right of withdrawal or any other right to a refund under the law is exercised in accordance with the proper procedure shall be made in accordance with the timeframe and method prescribed by the applicable laws.
Unless otherwise provided by law, refunds shall be made using the same payment method the Buyer used at the time of purchase, without imposing any additional costs on the consumer.

13. Defective Goods or Services
In the event that the delivered product or provided service is defective, the Buyer reserves the rights granted under the Consumer Protection Law No. 6502 and relevant legislation.
No provision in this Preliminary Information Form may be interpreted in a way that would eliminate or limit the consumer’s rights arising from mandatory legislation.

15. Resolution of Disputes
In the event of consumer disputes arising from this Preliminary Information Form and distance sales transactions, claims may be filed with Consumer Arbitration Boards or Consumer Courts within the monetary limits and jurisdiction rules set forth in the applicable legislation.
The consumer’s other rights to file complaints and initiate legal proceedings under applicable law remain reserved.

The buyer is provided with the opportunity to review the Pre-Contract Information Form electronically and to confirm that they have received the pre-contract information during the ordering process.
This Preliminary Information Form is to be considered in conjunction with the order details and the Distance Selling Agreement.
